Mars teleronot User service agreement and privacy agreement

Dear customer, welcome to the Mars Telerobot APP software. These terms and conditions are a contract between you (referred to as "User") and Mars Telerobot APP (hereinafter referred to as "Mars Telerobot ", “we”, “our” or “us”) regarding the use of the "Mars Telerobot " software service. You can use Mars Telerobot APP for self-service operations such as data queries and usage. When you are registering, logging in or using Mars Telerobot APP, you are required to enable the phone call recording function throughout the process. If you disable the phone call recording function, it will result in exiting Mars Telerobot APP. We promise to take corresponding security measures to protect your personal information.

To become a user of Mars Telerobot APP, please read carefully, agree to and accept the following terms and conditions. Thank you!

A. Definitions

1. This APP: Unless specifically indicated or stated otherwise in these terms and conditions, it refers to the "Mars Telerobot APP" software owned and operated by Mars Telerobot .

2. User/You: Refers to a natural person, legal entity, or other organization that agrees to and complies with these terms and conditions, completes all registration procedures of this APP, and, upon confirmation by this APP, possesses a User login account and password for this APP.

3. User Information: Refers to the User's registration information and transaction information submitted by the User when using the user services of this APP and known to this APP.

4. User Registration: Refers to the process in which the user logs into the Mars Telerobot APP, fills in relevant information as required, and confirms agreement to abide by these terms and conditions.

5. User Registration Information: Refers to various information registered by the User in this APP, including any modifications made to the information after identity verification.

6. User Instructions: In these terms and conditions, unless specifically indicated or stated otherwise, it refers to applications or requests submitted by the User to this APP in the form of electronic data, including but not limited to requests for this APP to provide, modify or cancel various services that the User is entitled to according to the operating procedure of this APP.

7. User Service Agreement/Product Usage Agreement: An agreement and/or contract separately signed by the User and Mars Telerobot regarding the provision of related services, according to the rules and regulations of Mars Telerobot .

8. User Service: Refers to the services provided by this APP to Users through the internet, including marketing, business inquiries, business transactions, customer service, and other related services.

B. Confirmation and Acceptance of Contract Terms

1. We hereby remind you to carefully read these terms and conditions before proceeding with registration and account login. If you have any objections to any terms of this contract and/or any terms that may be modified or supplemented at any time in the future, you may choose not to become a User of this APP.

2. When you click the "Agree" button, you are deemed to have carefully read these terms and conditions and agreed to accept all the terms of this contract, including accepting any modifications made by us to the terms of this contract at any time and are willing to be bound by them.

3. We have the right to modify the terms of these terms and conditions when necessary. If you do not agree to the modified content, you can cancel your User account. If the User continues to enjoy the services provided by us, it is deemed acceptance of the changes to the terms and conditions.

4. We reserve the right to decide at any time to change, upgrade, modify or transfer this APP and its related functions. We further reserve the right to develop new features or services in this APP or other languages. The provision of all new features and software services mentioned above, unless otherwise stated by us, still applies to these terms and conditions.

C. Service Content

1. We will provide Users with the User Services in accordance with these terms and conditions and related operational procedures. We will ensure the legality of the User Services we provide and is obligated to maintain the standard operation of online services and transactions based on existing technology. We endeavor to enhance and improve technology to ensure the smooth progress of User online services.

2. The User Services provided by us include User registration, login, secure logout, password recovery, password modification, order inquiry, and other services. We have the right to adjust the specific content of User Services according to changing circumstances.

3. We only provide online services and Users are responsible for the communication equipment (such as computers, modems, and other devices related to internet access) and the expenses related to communication services (such as telephone and broadband fees paid for internet access).

4. Users understand and acknowledge that we may include services provided by third parties, which are provided for the convenience of Users as functional modules. If Users wish to use such services, they should separately reach a service agreement with the service provider, pay the corresponding fees, and bear possible risks. We do not provide any form of guarantee for services provided by third parties.

D. Usage Rules

1. Users must ensure the authenticity, accuracy and completeness of their identity information when applying to create an account. In the event of any changes to the information, Users should promptly update it. We are not liable for any losses or damages resulting from inaccurate, untrue, or untimely updated information, or from the User's loss of identity information and passwords. If a User provides erroneous, false, outdated, or incomplete information and this is known to us or there are reasonable grounds to suspect such inaccuracies, we have the right to suspend or terminate the User's account and refuse all or part of the current or future use of the service. We have the right to inspect User Registration and creation data and related operations. In the presence of any issues or suspicions in the registration data or related operations, we may issue inquiries, request corrections, or take actions such as deletion.

2. User login accounts and passwords are the sole proof of identity of Users for us. To enjoy the User Services provided by us, Users must enter the correct login account and password according to the corresponding service requirements. Users are responsible for safeguarding their login accounts and passwords and passwords can be changed at any time during subsistence of this contract. We are not responsible for the loss, forgetfulness, or theft of login accounts or passwords if not caused by us. If Users discover the leakage of personal information, especially regarding account and password leakage, they should immediately contact us.

3. During the use of User Services provided by us, Users must adhere to the following principles:

(a) comply with relevant laws, regulations, and policies periodically formulated by the government of China;

(b) do not use the network service system provided by us for any illegal purposes;

(d) prohibit the sale, resale, or replication of the usage permissions granted by us;

(e) prohibit the imitation of Mars Telerobot 's products and services for commercial purposes;

(f) prohibit copying and imitating Mars Telerobot 's design concepts, interfaces, functions, charts, documents, software, trademarks, FLASH, designs, patterns, audiovisuals, photography, animations, fine arts, etc;

(g) prohibit modification or creation of derivative products based on the network services or their content provided by us without Mars Telerobot 's permission;

(h) prohibit the transmission of information that violates laws, regulations, information industry standards, or Mars Telerobot 's relevant provisions. The information transmitted should not contravene public interests or public morals. Additionally, the sending and storage of computer codes, files, scripts, and programs containing viruses, worms, trojans, or other harmful elements are strictly prohibited.

4. (a) Users are prohibited from engaging in any actions through us that may adversely affect the normal operation of the Internet;

(b) Transmission of any illegal, harmful, threatening, harassing, infringing, defamatory, vulgar, obscene, libelous, indecent, privacy-invasive, racially discriminatory, or otherwise unpleasant content, including but not limited to text, software, music, photos, graphics, videos, or other materials, is strictly prohibited;

(d) Impersonation of any person or entity, or falsely claiming an association in a deceptive manner, is strictly prohibited.

5. Users must log in and use this APP through the systems specified by us. Mars Telerobot and we will not be held responsible for any consequences resulting from logging in or using this APP through other means. If Users utilise services provided by any third party through this APP, we will not be liable for any disputes between the User and the third party.

6. Users acknowledge that they bear full responsibility for all consequences arising from activities conducted through our services. In the event that the actions of a User using this APP result in us or any third party assuming related liabilities, the User agrees to fully compensate us or any third party for associated expenses and losses, including legal fees and litigation costs.

E. User Privacy Protection

In accordance with the requirements of the laws and regulations of the , Users are required to cooperate by presenting valid documentation and undergoing verification and registration when conducting relevant transactions at various Mars Telerobot outlets (including apps, management platforms, authorized cooperative agents, etc.).

The registration information includes name, ID type, number, address, etc. Additionally, for better service provision, Users may be required to provide information such as contacts and phone numbers.

4. Users have the right to access their own information or request for their information through the mobile app. If a User refuses to provide personal, valid, and truthful information in accordance with the law, we reserve the right to cease or terminate services. To offer high-quality, personalised services, including but not limited to communication services, ensuring the security of communication services, improving service quality, and recommending personalised products, we will adhere to legal, legitimate, and necessary principles. We will use and retain Users’ personal information in accordance with legal regulations and/or these terms and conditions. The information will be handled with care, kept confidential, and protected in accordance with the law.

5. We reserve the right to analyse the entire user database and utilize the information for legitimate purposes without disclosing individual User Information.

6. We will establish a reasonable security system within our network system, including identity recognition and internal security measures, to ensure the integrity and confidentiality of User data. While Users understand and agree that technological methods are continually evolving and it is impossible to eliminate all non-security factors, we will regularly update our systems and diligently maintain the network and related data.

7. We place great importance on User privacy and the protection of personal information, making every effort to ensure the security and reliability of your personal information. We are committed to maintaining your trust and safeguarding your personal information. Before using our products or services, please carefully read and understand the "Mars Telerobot User Privacy Policy" published on this APP. We aim to transparently introduce how Mars Telerobot collects, stores, uses, discloses, and protects your personal information. By initiating the use of our products or services, you indicate your understanding and agreement with the entire content of the "Mars Telerobot User Privacy Policy"

F. Service Changes, Interruption, or Termination

In the event of the need for system maintenance or upgrades requiring the temporary suspension of network services, we endeavour to provide prior notice.

1. We have the right to unilaterally terminate the services provided to you without prior notice if it determines that your actions do not comply with the relevant requirements. Instances include but are not limited to:

(a) Provision of untrue registration information by the User;

(b) Violation of the usage rules stipulated in these terms and conditions;

(d) Risks and liabilities arising from such termination are solely your responsibility. If losses are incurred by Mars Telerobot or us, you are also obligated to compensate for such losses;

(e) User violations of other provisions of these terms and conditions.

2. Termination of this contract implies the termination of your services on this App. Immediately upon termination, we will not retain any content in your customer login account and are not responsible for transmitting unread or unsent messages to you or any third party.

3. The termination of this contract does not preclude the User from the payment obligations related to the effective period of this contract.

4. The termination of this contract does not automatically revoke your uncompleted instructions or eliminate legal consequences resulting from transactions before termination.

5. We reserve the right to interrupt or terminate, in whole or in part, network services at any time without prior notice. For any losses resulting from the interruption or termination of all services, we are not liable to the User or any third party.

G. Intellectual Property Rights

We possess the copyright, trademark rights, trade secrets, and other related intellectual property rights of this client, including but not limited to various documents, software, trademarks, FLASH, designs, patterns, audiovisuals, photography, animations, fine arts, etc. Any other rights not mentioned in this contract are also owned by us.

1. Mars Telerobot and related Mars Telerobot logos are the intellectual property of Mars Telerobot and are protected by copyright law, trademark law, and other intellectual property laws. Unauthorised copying, imitation, use, or publication of these logos is strictly prohibited.

2. Users are not allowed to implement, utilize, transfer, or license the aforementioned intellectual property for any profit or non-profit purposes without prior written consent from Mars Telerobot .

H. Disclaimer

1. We are not liable to Users or any third party for any damages of any nature arising from interruptions or failures in the communication system or the Internet, technical malfunctions, computer errors or viruses, information damage or loss, or any other disruptions beyond our reasonable control.

2. We do not guarantee uninterrupted or error-free operations when Users are using this APP. We do not guarantee the correction of all defects in this APP or that this APP will meet all User’s requirements.

3. We do not guarantee that the provided network services will necessarily meet the User's requirements. There is no guarantee against interruptions in network services, and no assurances are provided regarding the timeliness, security or accuracy of network services.

4. Users hereby agree that, under any circumstances, Mars Telerobot is not responsible to Users or any third party for delays, inaccuracies, errors, or omissions in the transmission or communication during the use of this APP, and for any resulting damages.

5. To the extent permitted by applicable law, neither party is obligated to compensate the other for the loss and/or damage of data or any indirect, incidental, special, consequential losses (including but not limited to lost profits, business interruption, loss of commercial information, loss of goodwill, or other economic losses).

6. Both parties acknowledge that this clause reflects their mutual agreement reached through negotiation. Both parties fully understand the consequences of this clause and further recognize its reasonableness.

I. Links from this APP

In certain situations, we may provide links to pages or applications on the international network. These links will redirect you to websites or applications operated by third parties who are not affiliated with Mars Telerobot or its partners.

1. We include these links within the APP solely to assist Users in browsing and for reference purposes. We are committed to selecting reputable websites, applications, and information sources for User convenience. However, unless we have explicitly stated a cooperative relationship with the third party, providing links to the websites, pages, or applications of such third parties does not imply Mars Telerobot 's agreement, recommendation, endorsement, guarantee, or endorsement of any third party or any services or products provided on their websites or clients. It also does not imply any form of cooperation between Mars Telerobot and the third party or its websites and applications.

2. We also include links to other Mars Telerobot ’s applications for your convenience. The products and services provided by these applications are intended for use only by individuals located or residing within the respective jurisdiction. Each Mars Telerobot application may have its own terms of use, which may vary. You should carefully review the applicable terms of use before using the relevant applications.

3. If you wish to establish a link to this application in any form from a third-party website or application, you must obtain written consent from Mars Telerobot . Mars Telerobot reserves the right to decide whether to approve the establishment of such links. Mars Telerobot is not responsible for the establishment and configuration of links from third-party websites or applications to this APP. The creation of such links does not constitute a collaboration between Mars Telerobot and the third-party website or application, nor does it imply Mars Telerobot 's endorsement of the third-party website or application. Mars Telerobot assumes no responsibility for any loss or damage incurred by you or third parties as a result of or related to such links. For links approved by Mars Telerobot in a pure text format or any other form, Mars Telerobot reserves the right to revoke approval at any time and may request the removal of any link pointing to this application.

4. Force Majeure:

In the event of unforeseeable circumstances such as hacker attacks, government regulations, or network communication failures that neither party could anticipate , both parties acknowledge that this constitutes force majeure. The parties shall, based on the impact of force majeure on the performance of this contract, negotiate to determine whether to terminate this contract, exempt certain obligations under this contract, or postpone the performance of this contract.

J. Law and Dispute Resolution:

This contract is governed by the laws and regulations of the People's Republic of China.

1. In the event of a specific matter under this contract lacking clear legal provisions, reference should be made to general international business practices and/or industry norms.

2. In case of a dispute arising from the signing , performance, or interpretation of this agreement, both parties shall make efforts to resolve it amicably through negotiation. If negotiation fails, either party has the right to file a lawsuit with the competent people's court in the jurisdiction where the server hosting this client is located .

K. Assignment of Agreement:

Unless our prior written consent has been obtained, the User may not assign their rights and obligations under this contract to any third party.

1. These terms and conditions constitutes the complete contract between the User and Mars Telerobot regarding the use of this APP and supersedes any prior oral or written agreements on matters covered by these terms and conditions.

2. If any provision of these terms and conditions is deemed invalid or unenforceable, that provision shall be separated, and the remaining parts shall remain in full force.

3. The headings in this agreement are for convenience only and do not define, limit, interpret, or describe the scope or limits of the provisions.

4. If we waive the rights specified in these terms and conditions due to User’s fault or breach, it does not constitute a waiver of other or similar faults or breaches by the User in the future.
